League City Divorce Mediation Attorney

Mediator Qualifications

Mediators are board-certified in family law and are usually actively practicing attorneys who are trained in mediation. Usually, the parties choose a mutually agreed-upon mediator, but if they are unable to come to an agreement, the court will appoint one.

Once all parties have disclosed relevant information concerning assets and debts and have identified issues of primary concern, they can schedule an appointment with a mediator. The parties then meet at the mediator’s office, where one party and his or her attorney will consult in one room while the other party remains in another private room. The mediator goes back and forth between the parties and attempts to discover the main issues over which the couple disagrees, while also presenting possible compromises.

Confidentiality

According to the Rules of Mediation, all communications that take place during mediations are confidential. This means that no one can repeat anything that was said in later court proceedings, including any settlement offers or demands that may have been made. In fact, the mediator is not even permitted to tell one party or his or her attorney what was said in the other party’s room without obtaining express permission. This confidentiality allows the parties to take part in an honest discussion without fear that their statements will be disclosed at a later date.

If a case cannot be settled through mediation, the parties will have to go to court and let a judge make the final decision. Sometimes, certain issues are resolved, but a couple comes to an impasse on a particular problem. In these situations, the parties will only need to go to court to resolve the remaining undecided issues.
